Whereas, The California Education Code §72023.5 (a) states that “The governing board of each community college district shall order the inclusion within the membership of the governing board, in addition to the number of members otherwise prescribed, of one or more nonvoting students who are residents of California as determined pursuant to Part 41 (commencing with Section 68000);”

Whereas, All California community colleges are committed to their districts’ non-discrimination policy, which generally states that no student enrolled within the district shall be unlawfully subjected to discrimination or denied full and equal access to the benefits of district programs or activities on the basis of ethnic group identification, race, color, ancestry, national origin, and citizenship;

Whereas, The California Education Code §72023.5 (a) has restricted all non-California residents, such as out-of-state, immigrant, and international (F-1) students, from participating in district activities as a district student trustee, thus violating the non-discrimination policy; and

Whereas, Non-California residents can contribute and have contributed their services to the California community college students through leadership, advocacy, and representation;

Resolved, That the Student Senate for California Community Colleges work with the Chancellor’s Office to amend the California Education Code §72023.5 (a) to read: “one or more district students who are residents of California as determined pursuant to Part 41 (commencing with Section 68000).”
Status
Completed. AB 844 (Ch 619, Statutes of 2012) amended the Education Code to allow students who are exempt form paying non-resident tuition to serve as Student Trustees.
