Whereas, California Education Code Section 76360 lacks any measures for the consideration of alternative transportation methods before increasing student parking fees to fund construction of additional parking areas; and
Whereas, California Education Code Section 89701, clause b, part 4 allows California State Universities to allocate funds for the construction of parking facilities only after investigating and considering alternative transportation methods.
Whereas, California Senate Bill 375 was approved as a way for California to adopt a sustainable communities strategy and reduce greenhouse gas emissions, through metropolitan planning organizations;
Resolved, That the Student Senate for California Community Colleges urge the amendment of California Education Code 76360, clause b, part 1, and to add subsection (A), to read:
76360 (b) (1) The governing board may require payment of a parking fee at a campus in excess of the limits set forth in subdivision (a) for the purpose of funding the construction of on campus parking facilities if all of the following conditions exist at the campus:
(A) Programs incorporating alternate methods of transportation have been thoroughly investigated, considered and proposed, as determined by the alternative transportation committees of each campus and the trustees, in consultation with students and local government
officials, pursuant to SB 375, as part of the sustainable communities initiative.
(B) The fulltime equivalent student (FTES) per parking space on the campus exceeds the statewide average FTES per parking space on community college campuses.
(C) The market price per square foot of land adjacent to the campus exceeds the statewide average market price per square foot of land adjacent to community college campuses.
