Whereas, the Student Senate for California Community Colleges (SSCCC) is an organization comprised of students required to comply with Education Code with regard to eligibility to participate in the SSCCC, and the State Chancellor’s office is required to verify such eligibility prior to the funding of any expense related to a member of the SSCCC Council;

Whereas, the Student Senate for California Community Colleges Council has solicited the advice of Legal Counsel of the State Chancellor’s office, and has received the advice sought;

Whereas, the Student Senate for California Community Colleges is supported, in many ways, by the Chancellor’s office, including but not limited to advice on legal issues, procedures, processes, etc., and the Chancellor’s office has continued to be the body who has conducted the process of verifying the eligibility of SSCCC members;

Whereas, eligibility is the fundamental and foundational minimum measurement the students have to be certain that SSCCC Council Members are legitimate and competent student leaders; and the Student Senate for California Community Colleges Council has an obligation to act transparently and in an exemplary role, and follow the same rules and regulations as all other students in the state – without excuses, exceptions or special treatment;

Resolved, That the Student Senate for California Community Colleges shall modify the SSCCC By-Laws, Article II, Section 3.A to read as follows:
Section 3: Vacancies

Regional Senator Vacancies:
If a vacancy occurs, the vacancy shall be filled by the following procedures:
If the vacancy occurs by way of resignation made to the Region body or removal of the Regional Senator by the Region body, the Region Chair or his/her delegate shall notify the SSCCC Secretary, at which time the position shall be considered vacant. Otherwise, if the vacancy occurs by way of resignation made to the SSCCC Council or by removal of the Regional Senator by the SSCCC Council, the SSCCC President shall declare the position vacant.
The SSCCC president will request that an election for a new representative from the region be held.

Once the region certifies the election of the new SSCCC regional representative based on SSCCC policies and procedures, the new representative shall complete all necessary eligibility forms as required by the Chancellor’s Office of the California Community Colleges SSCCC eligibility review process.
Once all necessary forms are completed and the CCCCO verifies student eligibility to serve on the SSCCC, the president of the SSCCC shall swear in the new member.
